Terms and Conditions, Terra AC Cashback Program, v2.1 Nov, 20 2023

"Cashback" promotion for the installation of an ABB Terra AC Wallbox by installers in Italy during the promotion period from December 19th to February 29th, 2024.

1. Provider and Purpose ABB E-mobility B.V. Heertjeslaan 6, 2629JG, 2629 JD Delft, Netherlands (hereinafter referred to as 'Provider')

   
   Purpose of the Cashback Program: This program aims to pay a premium of €75 for the successful installation of a Terra AC Wallbox of the Provider (hereinafter referred to as 'Device'). Eligible participants are installers (hereinafter referred to as 'Participants') located and operating in Italy, who meet the participation conditions mentioned in point 3.

2. Promotion Period: Registration for the Cashback Program starts on 19.12.2023 and ends on 29.02.2024. Submissions are typically reviewed within four weeks of completing the device's full registration.
3. Proof and Participation Conditions:
   1. Participants must register an account on cashback.e-mobility.abb.com and confirm the provided email address.
   2. Participants must register the device specifying the device serial number.
   3. The device must be updated to the latest firmware version once.
   4. The device must have been online for the first time within the promotion period.
   5. A transfer declaration from the end user must be present. This is done electronically via the [ABB Terra App] of the participant.    6. Complete device registration requires the successful upload of the corresponding shipping note. The shipping note must clearly show the following information:
      1. Purchase date
      2. Buyer (details must match the participant registration information)
      3. Wholesaler/Seller
      4. Product name
      5. Product serial number
   7. If multiple devices were purchased at the same time, these devices must be registered individually, and the same invoice/shipping note must be submitted with every device registered.
4. Payment of the Cashback Premium: After successful verification of the submitted documents, the premium of €75 will be paid to the participant. Payment is made within four weeks of confirming the participant's eligibility by bank transfer.
5. Provision of Bank Details: Participants are required to provide their correct bank details on the program website cashback.e-mobility.abb.com to facilitate the transfer of the premium.
   1. No verification by the provider: The provider assumes no responsibility for verifying the accuracy of the provided bank details. Participants are solely responsible for the accuracy and completeness of their provided bank information.
   2. Disclaimer of liability for incorrect transfers: The provider is not liable for erroneous transfers resulting from faulty or incomplete bank details provided by the participants.
   3. No repeated transfer: In case of a failed transfer due to incorrect or incomplete bank details entered in the portal by the participant, no repeat transfer will be made. It is the responsibility of the participant to ensure that all provided bank details are correct.
   4. Limitation of bank transfers to EU countries: Transfers to bank accounts outside the EU are not possible. Participants who do not provide a valid EU bank account may be excluded from the cashback payment.
   5. The participant agrees that the provider may pass on these bank details to the service provider Wildstyle Network GmbH (see point 8) for the purpose of the bank transfer.
6. Eligibility: Only participants located in Italy who have installed the promotional product within the promotion period are eligible. Wholesalers, retailers, and private individuals are excluded from participation. Private sales/purchases and sales/purchases via online auctions (e.g., eBay) and sales/purchases of used devices are also excluded. Wallboxes eligible for registration are solely those that have been purchased through authorized wholesalers. The wallboxes cannot be directly purchased through ABB.
7. Tax Responsibility of the Participants: The participants are responsible for the taxation of the received cashback amount according to the applicable tax laws in their respective country. As the cashback amount is paid without consideration, it can be considered as neutral income for tax purposes. The provider does not provide tax documents and is not responsible for the tax treatment of the cashback amount on the part of the participant.
8. Payment Information by Wildstyle Network GmbH: The provider commissions Wildstyle Network GmbH as a service provider for the execution of the cashback payment. This provider will provide a payment information to the participant for the payment made. The payment information can be downloaded by the participant on the website, within the overview of the registered devices. Beyond the payment information, no further details are passed on to the service provider. The service provider does not provide any further documents regarding the cashback program other than the payment information.
9. Scope: This action is exclusively valid in Italy during the mentioned promotion period.
10. Exclusion from Participation: Participants who violate these terms and conditions, make false, misleading, or fraudulent statements, may be excluded from the promotion. Applications submitted after the promotion period are excluded from participation.
11. Changes to the Terms of Participation: The provider reserves the right to terminate, extend, or change the terms of participation prematurely. Changes or termination of the action will be announced on the website cashback.e-mobility.abb.com. A rejection of participation in this cashback program does not require a justification. We are entitled to exclude the participant permanently or temporarily from further participation in the cashback program.
12. Data Protection: Participants agree to the processing of their personal data for the purposes of the action.
13. Disclaimer: The provider is not liable for technical problems that may affect participation in the program or the transmission of information.
14. Legal Recourse: By participating in the promotion, the participant agrees to these terms and conditions. Legal recourse for reviewing the provider's decisions within this program is excluded.
15. Applicable Law: These terms and conditions are subject to the laws of the Netherlands.
16. Severability Clause: If parts of these terms and conditions should be invalid, the validity of the remaining provisions remains unaffected. Instead of the invalid provision, a regulation comes into effect that comes closest to the original purpose.
